You must carefully read the terms set forth in these Terms of Use and in the Privacy Policy, as these terms govern your use of, access to, and all interactions with the www.siaq.org website (hereinafter referred to as the “Website”). For purposes of these Terms, the term “Website” includes all web pages linked to the Website that are accessible to Website visitors or SIAQ members, including the online store accessible via the page https://siaq.org/fr/boutique/ (hereinafter the “Store”). Use of the Website is conditional upon your acceptance of these Terms and Conditions (hereinafter referred to as the “Terms”) and the Privacy Policy.
When using the Website, you must at all times behave respectfully and, in particular, you may not make any statements that could, directly or indirectly, harm, harass, abuse, threaten, or intimidate any other person in any way, nor may you make statements that could encourage, promote, or foster violence, hatred, cruelty, or discrimination against any person or group, or cruelty toward animals. The SIAQ reserves the right at any time, in the event that it determines that a user has violated the Website’s general terms of use—and in particular the provisions of this paragraph—to remove all of the violator’s posts from the Website, to suspend and prohibit the violator’s future access to the Website, unless the violator obtains special authorization from the SIAQ.
SIAQ is a nonprofit corporation incorporated under the Corporations Act, Part 3. It brings together professionals dedicated to the care and preservation of trees, and its mission is to foster a greater appreciation of trees and to promote research, technology, and the professional practice of arboriculture. It offers its members products and services, including training, related to the field of arboriculture.
1. Consent and Acceptance of the Terms of Use and Privacy Policy
These Terms of Use, as well as the Privacy Policy to which they refer, govern your visit to and use of the Website. By accessing the Website, you confirm that you, as well as any person you claim to represent, agree to be bound without limitation by these Terms of Use and the Privacy Policy. By accepting these Terms, you represent and warrant that you, and any person you claim to represent, have the legal capacity and necessary authorizations, if any, to accept the Terms of Use and the Privacy Policy on your own behalf or on behalf of any person you claim to represent. When you accept these Terms of Use, an agreement is formed between you, as well as the persons you claim to represent, and SIAQ regarding your access to and use of the Website, as well as with respect to any content, information, products, and services available through the Website.
If you do not accept each and every provision of these Terms of Use and the Privacy Policy without reservation—other than as limited in the Privacy Policy—or if you are not authorized or empowered to accept the Terms of Use and the Privacy Policy, or if you do not have the necessary authorization to accept them on behalf of any person you claim to represent, you are not authorized to access or use the Website and must immediately cease accessing or using the Website.
2. License to Use
2.1. If you wish to become a member of SIAQ, we need your name and complete contact information in order to register you, manage your membership (such as sending an invoice), and provide you with the services to which you are entitled based on your membership type.
2.3. You may not modify the form or content of the Website in any way.
2.4. The Website, including all of its content—such as icons, graphics, images, and all information contained in the text, as well as any audio and video clips, software, applications, and any other elements available on the Website—is the exclusive property of SIAQ and is protected by Canadian and international copyright and trademark laws.
2.5. All rights not expressly granted by these Terms are reserved exclusively by SIAQ.
2.6. You may not include all or part of the Website’s content or associate its content, in whole or in part, with any products or services that you create, distribute, or represent, or with any other product or service whatsoever, nor may you reproduce all or part of the Website’s content.
2.7. You may not use the Website in any manner that could cause harm, disable, overload, damage, compromise the security of visitors or members, negatively affect its operation, or otherwise compromise the integrity of the Website, its reputation, and that of its visitors, users, and members; nor may you take any action that could compromise the resources of server accounts, networks, affiliated or linked sites, connected to or accessible through the Website.
2.8. You may not attempt to, or take any action in any manner whatsoever that is likely to infringe or that infringes upon the legal protection of privacy rights, copyrights, or other intellectual property rights, or any action that is illegal, unethical, indecent, offensive, fraudulent, defamatory, misleading, vulgar, obscene, racist, degrading, or otherwise unacceptable, or likely to cause harm to others or to a group.
2.9. You may not, in any way, use the Website for commercial purposes or to conduct commercial activities on it, whether directly or indirectly, without first obtaining written authorization from the SIAQ, which authorization may be denied at its sole discretion.
2.10. Without limiting the generality of the foregoing, you are strictly prohibited from violating or attempting to violate the security of the Website, including, without limitation: (i) accessing or attempting to access files not intended for general user viewing, or accessing the server or a secure account without the required access permissions; (ii) attempting to bypass or test, or bypassing and testing the vulnerability of security systems or authentication measures in place without appropriate prior authorization; (iii) attempting to interfere with or disrupt, or interfering with and disrupting, access to the Website or communications through the Website, including, without limitation, by introducing viruses, overloading or flooding communications, sending spam, or using other methods; (iv) sending unsolicited emails, including promotions or advertisements for products and services; (v) to forge or manipulate your identity or the identity of any subscriber for the purpose of disguising or concealing the origin of any information transmitted to or through the Website, or in connection with the services, whether directly or indirectly through third parties or third-party computer systems; (vi) to use or attempt to use any device, software, agent, or other mechanism, robot, website, manual or automated application, or to otherwise replicate the navigation structure or layout of the Website and its content; (vii) modify, adapt, sublicense, translate, sell, reverse engineer, compile, or decompile, or otherwise attempt to deconstruct, appropriate, or misappropriate all or part of the Website or any software used on it or in connection with the services, or encourage others to do so.

The trademarks, associated designs, and any other names and logos appearing on the Website constitute registered or unregistered trademarks and trade names belonging to SIAQ or their respective owners or licensees (hereinafter collectively referred to as the “Trademarks”).
Any use of the Trademarks not authorized by SIAQ or not in accordance with the Terms is prohibited. Under no circumstances may the Terms be interpreted as constituting any authorization by the licensee or owner to use, in whole or in part, the Marks—including those displayed on the Website—or the intellectual property rights held by SIAQ, including copyrights in the Website’s content.
Unless the information is in the public domain or you have obtained appropriate prior written authorization from SIAQ, you may not copy, modify, publish, transfer, transmit, distribute, produce, display, or otherwise sell any information owned by SIAQ, including all intellectual property such as the Trademarks and copyrights, unless you are otherwise expressly authorized to do so by the Terms and Conditions.
4. Store and Memberships
4.1 Terms for Purchases in the Online Store (books and accessories, excluding training courses)
Final sales.
No exchanges or refunds.
No price adjustments for orders placed without logging into a member profile.
A 5% administrative fee will be charged on any order for reserved items placed by an individual or company that does not hold the necessary rights or titles to make the purchase.
4.2 Terms for Training Workshops and Conferences
No cancellations after the registration deadline.
No refunds after the registration deadline.
You may transfer a registration to another person up to 24 hours before the event (unless otherwise specified).
Any cancellation or refund request received before the registration deadline is subject to a 5% administrative fee, which will be deducted from the refund.
In the event of a refund, books included in a training course that have already been delivered are non-refundable and will be deducted from the refund based on the retail price corresponding to your membership status.
If you are a member, you must log in to your account to receive the member rate. No price adjustments will be made if an order is placed as a guest.
4.3 Membership Terms
Individual memberships are non-refundable and non-transferable.
Municipal memberships are non-refundable but may be transferred to another person.
Commercial memberships are non-refundable.
4.4 Shipping
Shipping in Canada
> Standard delivery times generally range from 2 to 7 business days.
> Orders shipped via Xpresspost or Priority must be placed before 11 a.m. for same-day shipping.
> The SIAQ cannot be held responsible for delivery delays by Canada Post.
> Non-delivery and package tracking: By choosing a non-trackable shipping method, the customer assumes all risks associated with the loss, delay, or non-delivery of their package. SIAQ cannot be held responsible for these situations, and no refund or replacement will be provided.
Shipping to the United States or Internationally
> For shipments to the United States and other countries, SIAQ cannot guarantee a delivery date. Delivery times provided by third-party carriers and customs processing times are typically approximate.
> Recipients are responsible for paying customs duties, taxes, and other additional fees for all orders outside of Canada.
> Trackable shipments: In the event of non-delivery of a trackable package, a claim must be filed with the carrier.
> Non-trackable shipments: By choosing a non-trackable shipping method, the customer assumes the risks associated with the loss, delay, or non-delivery of their package.
> Tracking is not available for shipments via Canada Post’s U.S. Surface Small Package and International Surface Small Package services.
5. Usernames and Passwords
The Website contains certain sections that are accessible only to SIAQ members who have been assigned a username and password by SIAQ. These usernames and passwords remain the property of SIAQ and, as such, may be canceled or suspended at any time by SIAQ, at its sole discretion, without prior notice and without incurring any liability whatsoever.
If you have been issued a username and password, you are responsible for maintaining their confidentiality and for protecting yourself against any illegal, fraudulent, or unauthorized use of that username or password on the Website. You are also responsible for any use that may be made of your username and password. In the event that you discover that your username or password may have been compromised, you must immediately notify SIAQ by contacting us through the Website, either by email at info@siaq.org or by phone at 1-450-689-9393.
SIAQ is under no obligation to verify the identity or authority of any person using a member’s username or password, nor does it have any obligation to verify the true identity of any person who registers on the Website or requests the issuance of a username and password, or to verify such person’s eligibility under the Terms and Conditions.
6. Exclusion or Limitation of Liability
6.1. SIAQ is not liable for the online conduct—on or off the Website—of any Website user or member. You assume all risks directly or indirectly related to your use of the Website.
6.2. By becoming a member of the SIAQ, you agree that the SIAQ may publish your name and contact information in a directory accessible only to members. The SIAQ disclaims all liability regarding members’ use of this directory.
6.3. The SIAQ is not liable for any inaccurate or incomplete information or for any errors that may appear on the Website, including but not limited to, without limiting the generality of the foregoing, information regarding products and services sold in its online store, whether such errors, inaccuracies, or incomplete information originate from the suppliers and/or manufacturers of the products, the Website, from members, or from any equipment failure or malfunction, among other causes.
6.4. SIAQ is not liable for any errors, omissions, interruptions, delays, defects, delays in operations or transmission, errors or failures in online communication, theft, destruction, or any unauthorized access.
6.5. SIAQ is not liable for any problems or malfunctions in any telephone network or communication line,
online communication system, server, or provider, computer equipment, software, email malfunctions, technical issues, or internet traffic congestion—including any injury or damage to members, users, or visitors to the Website, or to any person’s computer—arising from or related to visiting the Website, downloading any material from the Website, or using SIAQ’s services.
6.6. SIAQ disclaims all liability, and it is understood that under no circumstances shall SIAQ be held liable for any loss or damage—including personal injury, property damage, or even death—resulting from or that may result from visiting the Website or using the services offered thereon, from the use of any content found on the Website or transmitted to members, or from any relationship, communication, or contact between members, whether online, on the Website, or elsewhere.

8. Modification and SIAQ’s Right of Termination
SIAQ reserves the right, in its sole discretion, to modify, interrupt, restrict, suspend, or terminate the Website at any time, in whole or in part, without prior notice and without incurring any liability to you or any other person.
SIAQ reserves the right, at its sole discretion, to remove, add, modify, or change the Terms and Conditions, in whole or in part, at any time. Any such changes will take effect as soon as they are posted on the Website.
It is your responsibility to review the Website Terms regularly to determine whether any changes have been made that may affect you. Checking the “Last Updated” date at the beginning of the Terms will allow you to verify whether any changes have occurred since your last visit or use of our Website. 9. Governing Law and Dispute Resolution
These Terms, your access to and use of the Website and the services, as well as any related matters, are governed by the laws of Canada and the province of Quebec. Any disputes between you and SIAQ or any other person associated with the Website, including any Subscriber, arising from these Terms or any agreement that may have been entered into, or arising from any communication with users or members, must be resolved by arbitration before a single arbitrator in accordance with the procedure established for this purpose by the Code of Civil Procedure of Quebec, in accordance with the provisions in effect at the time the dispute arises.
