Welcome to the www.siaq.org website, launched and managed by the Société internationale d’arboriculture Québec inc. (hereinafter referred to as the "SIAQ"). You must carefully read the terms outlined in these Terms and in the Privacy Policy as these terms govern your use, access, and all your interactions with the www.siaq.org site (hereinafter referred to as the "Website"). It is understood that the term "Website" includes all web pages related to the Website that visitors to the Website or SIAQ members can access, including the shop via the page https://siaq.org/fr/boutique/ (hereinafter the "Shop"). The use of the Website is conditional upon your acceptance of these Terms (hereinafter referred to as the "Terms") and the Privacy Policy.

When visiting the Website, you must always behave respectfully and, in particular, you cannot make any statements that could directly or indirectly harm, harass, abuse, threaten, or intimidate any other person in any way or make any statements that could encourage, promote, or foster violence, hatred, cruelty, or discrimination against any person or group, as well as any cruelty towards animals. The SIAQ is a non-profit corporation constituted under the Corporations Act, Part 3. It brings together professionals dedicated to tree care and preservation and aims to encourage greater appreciation of trees, promote research, technology, and the professional practice of arboriculture. It offers its members products and services, including training, related to the field of arboriculture.

1. Consent and acceptance of terms and the Privacy Policy

These Terms of Use and the Privacy Policy to which they refer govern the visit and use of the Website. When you access the Website, you confirm that you, as well as any person you claim to represent, agree to be bound without limitation by these Terms and the Privacy Policy. By this acceptance, you declare and warrant that you, as well as any person you claim to represent, have the legal capacity and the required authorizations, if applicable, to accept the Terms and the Privacy Policy on your behalf or on behalf of any person you claim to represent. When you accept these terms of use, an agreement occurs between you, as well as the persons you claim to represent, and the SIAQ with regard to your access and use of the Website and in relation to any content, information, products, and services available through the Website.

If you do not accept each and every provision of these Terms and the Privacy Policy without reservation, other than within the limitations of the Privacy Policy, or if you are not authorized or empowered to accept the Terms and the Privacy Policy, or if you do not have the required authorizations to accept them on behalf of any person you claim to represent, you are not authorized to access or use the Website and must immediately cease accessing or using the Website.

2. User license

2.1. If you wish to become a member of the SIAQ, we need your name and complete contact details in order to register you and ensure follow-up regarding the subscription, such as sending an invoice and providing you with the services to which you are entitled based on your type of subscription.

2.3. You may not in any way modify the form or content of the Website.

2.4. The Website, including all its content such as icons, graphic elements, images, and any information contained in the text, audio, and video tapes if any, software, applications, and any other element available on the Website is owned exclusively by the SIAQ and is protected by Canadian and international copyright and trademark laws.

2.5. All rights not expressly granted by these Terms are reserved exclusively to the SIAQ.

2.6. You cannot include any part of the content of the Website or associate its content in whole or in part with any products or services you create, distribute, or represent, or any other product or service whatsoever, nor reproduce in whole or in part the content of the Website.

2.7. You may not use the Website in a manner that could harm, disable, overload, deteriorate, impair the security of visitors or members, negatively affect its operation, or otherwise undermine the integrity of the Website, its reputation, and that of its visitors, users, and members, nor perform any action that could undermine the resources of server accounts, networks, affiliated or linked sites, connected or accessible through the Website.

2.8. You may not attempt in any way that could infringe or infringe the legal protection of privacy rights, copyright, or other intellectual property rights, or any action that is illegal, unethical, indecent, insulting, fraudulent, defamatory, misleading, vulgar, obscene, racist, degrading, or otherwise inadmissible or likely to cause harm to others or a group.

The trademarks, associated designs, as well as any other name and logo appearing on the Website, are trademarks and trade names, registered or not, owned by the SIAQ or their respective owner or licensee (hereinafter collectively referred to as the "Marks").

Any use of the Marks not authorized by the SIAQ or not compliant with the Terms is prohibited. At no time can the Terms be interpreted as granting the licensee or the owner any authorization to use any part of the Marks, particularly those displayed on the Website, or the intellectual property rights held by the SIAQ, including copyright on the Website content.

Except if the information is public domain or if you have obtained prior appropriate written authorization from the SIAQ, you cannot copy, modify, publish, transfer, transmit, distribute, perform, display, or otherwise sell any information owned by the SIAQ, including all intellectual property such as the Marks and copyrights, unless you are otherwise expressly authorized by the Terms.

4. Shop and Memberships

4.1 Terms for Books and Accessories

Final sales.
No exchanges or refunds.
No price adjustments for orders placed without a member profile login.

4.2 Terms for Training Workshops and Conferences

No cancellations after the registration deadline.
No refunds after the registration deadline.
You can transfer a registration to another person up to 24 hours before the event (unless otherwise indicated).
For a cancellation or refund request before the registration deadline, a 5% administrative fee will be deducted from the refund.
In the event of a refund, books included in a training and already delivered cannot be refunded and will be deducted from the refund according to the retail price based on your membership status.
If you are a member, you must log in to your profile to obtain the member rate. No price adjustment will be made if an order is placed as a guest.

4.3 Terms for Memberships

Individual memberships are non-refundable and non-transferable.
Municipal membership is non-refundable, but can be transferred to another person.
Commercial membership is non-refundable.

4.4 Shipping

Shipping within Canada
> Standard delivery times generally range from 2 to 7 business days.
> Orders shipped by Xpresspost or Priority must be placed before 11 a.m.
> The SIAQ cannot be held responsible for delivery delays by Canada Post.
> Non-delivery and parcel tracking: The SIAQ cannot be held responsible for delivery delays or loss of parcels if you choose a delivery method without tracking.

Shipping to the United States or International
> For shipments to the United States and other countries, the SIAQ cannot guarantee the delivery date. Delivery times made by subcontracted transport companies and customs delays are normally approximate.
> Recipients are required to pay customs fees, taxes, and other additional charges for all orders outside Canada.
> The SIAQ cannot be held responsible for non-delivery of parcels or untrackable packages.
> Shipments with tracking: In the event of non-delivery of a trackable package, a claim must be made with the carrier.
> Shipments without tracking: The SIAQ cannot be held responsible for delivery delays or loss of packages if you choose a shipping method without tracking.
> Tracking is not offered for shipments of Surface Small Packet USA and Surface Small Packet International services by Canada Post.

5. Login Names and Passwords

The Website includes certain sections that are only accessible to members of the SIAQ to whom a username and password have been assigned by the SIAQ. These usernames and passwords remain the property of the SIAQ and, consequently, they may be canceled or suspended at any time by the latter at its sole discretion, without notice and without in any way incurring liability.

If you have been issued a username and password, you are responsible for maintaining their confidentiality and protecting against any illegal, malicious, or unauthorized use of this username or password on the Website. You are also responsible for the use that may be made of your username and password. In the event that you become aware that your username or password may have been compromised, you must immediately notify the SIAQ by contacting us through the Website either by email at info@siaq.org or by phone at 1-450-689-9393.

The SIAQ is under no obligation to verify the identity or authority of any person using a member's username or password, nor is it obligated to verify the true identity of any person registering on the Website or requesting the issuance of a username and password or eligibility according to the Terms.

6. Exclusion or Limitation of Liability

6.1. The SIAQ is not responsible for online behavior on or off the Website by any user of the Website or a member. You assume all risks directly or indirectly related to visiting the Website.

6.2. By becoming a member of the SIAQ, you agree that the SIAQ may publish your name and contact information in a directory accessible only to members. The SIAQ disclaims any liability for the use of this directory by members.

6.3. The SIAQ is not responsible for any inaccurate or incomplete information or any errors that may be found on the Website, including but not limited to the products and services sold on its store, whether these errors or inaccuracies or incomplete information come from the suppliers and/or manufacturers of the products, the Website, the members, or any malfunction of equipment, in particular.

6.4. The SIAQ is not responsible for any error, omission, interruption, delay, defect, delay in operations or transmission, online communication errors or failures, theft or destruction, or unauthorized access.

6.5. In this regard, we refer you to our Privacy Policy, which includes our personal information protection policy published on the Website.

8. Modification and Right of Termination by SIAQ

The SIAQ reserves the right, at its sole discretion, to modify, interrupt, restrict, suspend, or terminate the Website at any time, in whole or in part, without notice and without incurring any liability to you or to any other person.

The SIAQ reserves the right, at its sole discretion, to delete, add, modify, or change the Terms, in whole or in part, at any time. The changes made will take effect as soon as they are available on the Website.

It is your responsibility to regularly review the Website's Terms to determine if any changes have been made that may affect you. Checking the date of the last update at the beginning of the terms allows you to verify if any changes have occurred since your last visit or use of our Website. If any change is unacceptable to you, you must immediately stop accessing and using the Website.

If you access and use the Website after changes to the Terms are posted online, you are deemed to have accepted them.

9. Applicable Laws and Dispute Resolution

These terms, your access and use of the Website and services, and any related matters are governed by applicable laws in Canada and the province of Quebec. All disputes between you and the SIAQ or any other person related to the Website, including any Subscriber, arising from these terms or any agreement or communications with users or members must be resolved by arbitration, by a single arbitrator in accordance with the procedure established for this purpose by the Quebec Civil Procedure Code, according to the provisions in force at the time of the occurrence of the dispute.

SMS Messaging Terms of Use

General

When you sign up for the service, we send you a message to confirm your registration.

By agreeing to receive messages, you agree to receive recurring automated marketing and informational messages from the Société internationale d’arboriculture Québec inc. (SIAQ). Automated messages may be sent using an automatic telephone dialing system to the mobile phone number you provided at registration or any other number you have designated.

Message frequency varies and additional mobile messages may be sent periodically depending on your interaction with the SIAQ. The SIAQ reserves the right to modify the frequency of messages sent at any time to increase or decrease the total number of messages sent. The SIAQ also reserves the right to change the short code, phone number, or alphanumeric sender from which messages are sent.

Standard message and data rates may apply. If you have questions about your text or data plan, it's best to contact your mobile service provider. Your mobile carrier is not responsible for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Operators

Operators are not responsible for delayed or undelivered messages.

Cancellation

Messages will provide instructions on how to unsubscribe, either by texting STOP or clicking a link included in the message. After your unsubscription, we will send you a message to confirm that you have been unsubscribed and that no more messages will be sent. If you wish to receive messages from the SIAQ again, simply sign up as you did the first time and SIAQ will start sending you messages again.

Number Transfer
