Welcome to the website www.siaq.org, launched and managed by the Société internationale d’arboriculture Québec inc. (hereinafter referred to as the "SIAQ"). You must carefully read the terms set out in these Terms and the Privacy Policy as these terms govern your use, access, and all your interactions with the site www.siaq.org (hereinafter referred to as the "Website"). It is understood that the expression "Website" includes all web pages linked to the Website that website visitors or SIAQ members can access, including the store via the page https://siaq.org/fr/boutique/ (hereinafter the "Store"). The use of the Website is conditional upon your acceptance of these Terms (hereinafter referred to as the "Terms") and the Privacy Policy.

When you visit the Website, you must always behave respectfully, and notably, you cannot make any statements that could directly or indirectly harm, harass, abuse, threaten, or intimidate any other person in any way, or make statements that could encourage, promote, or favor violence, hatred, cruelty, or discrimination against any person or group, as well as any cruelty towards animals. The SIAQ reserves the right at any time, if it deems that a user has violated the general conditions of use of the Website and specifically the content of this paragraph, to delete from the Website all interventions by the offender, to interrupt and prohibit future access by the offender to the Website, except following a special authorization that the offender must request from the SIAQ.

The SIAQ is a non-profit corporation established under the Companies Act, Part 3. It brings together professionals dedicated to the maintenance and preservation of trees and aims to encourage a greater appreciation of trees, promote research, technology, and the professional practice of arboriculture. It offers its members products and services, including training, related to the field of arboriculture.

1. Consent and Acceptance of Terms and Privacy Policy

These Terms of Use, along with the Privacy Policy to which they refer, govern the visit and use of the Website. When you access the Website, you confirm that you, as well as any person you claim to represent, agree to be bound without limitation by these Terms and the Privacy Policy. By accepting this, you represent and warrant that you, as well as any person you claim to represent, have the legal capacity and required authorizations, if any, to accept the Terms and the Privacy Policy on your behalf or on behalf of any person you claim to represent. When you accept these terms of use, an agreement is formed between you, as well as the persons you claim to represent, and SIAQ regarding your access and use of the Website as well as with respect to any content, information, products, and services available through the Website.

If you do not accept each and every provision of these Terms and the Privacy Policy without reservation, other than the limitations provided by the Privacy Policy, or if you are not authorized or entitled to accept the Terms and the Privacy Policy, or if you do not have the required authorizations to accept them on behalf of any person you claim to represent, you are not authorized to access or use the Website and you must immediately cease accessing or using the Website.

2. License of Use

2.1. If you wish to become a member of the SIAQ, we need your name and complete contact information to register you and ensure proper follow-up regarding the subscription, such as sending an invoice and providing the services you are entitled to based on your subscription type.

2.3. You cannot in any way modify the form or content of the Website.

2.4. The Website, including all its content such as icons, graphic elements, images, and all information contained in the text, audio and video tapes if any, software, applications and any other elements available on the Website, is the exclusive property of the SIAQ and is protected by Canadian and international copyright and trademark laws.

2.5. All rights not expressly granted by these Terms are exclusively reserved to the SIAQ.

2.6. You may not include any part of the Website's content or associate its content, in whole or in part, with any products or services you create, distribute, or represent, or any other product or service whatsoever, nor reproduce in whole or in part the content of the Website.

2.7. You may not use the Website in a way that could cause harm, disable, overload, deteriorate, compromise the security of visitors or members, negatively affect its operation, or otherwise compromise the integrity of the Website, its reputation, and that of its visitors, users, and members, nor take any action that could compromise the resources of server accounts, networks, affiliated or linked sites, connected or accessible through the Website.

2.8. You may not attempt to or take any action in any way that is likely to infringe or that infringes the legal protection of privacy rights, copyright or other intellectual property rights, or any action that is illegal, unethical, indecent, insulting, fraudulent, defamatory, misleading, vulgar, obscene, racist, degrading or otherwise inadmissible, or likely to cause harm to others or to a group.

2.9. You may not in any way use the Website for commercial purposes or to pursue commercial activities, directly or indirectly, without first obtaining written authorization from the SIAQ, which authorization may be refused at its sole discretion.

2.10. Without limiting the generality of the foregoing, it is strictly prohibited for you to violate or attempt to violate the security of the Website, including but not limited to: (i) accessing or attempting to access files that are not intended to be viewed by general users or accessing the server or secure account if you do not hold the required access authorizations; (ii) attempting to breach or test or breaching and testing the vulnerability of security systems, authentication measures put in place without appropriate prior authorization; (iii) attempting to interfere with or interrupt or interfering and interrupting the accessibility to the Website, communications through the Website, including but not limited to by introducing viruses, overloading or flooding communications, spam and other methods; (iv) sending unsolicited emails, including promotions or advertisements of products and services; (v) forging or manipulating your identity or the identity of any subscriber in order to disguise or conceal the origin of any information transmitted to the Website or through it or regarding the services either directly or indirectly through third parties or computer systems owned by third parties; (vi) using or attempting to use any device, software, agent or other mechanism, robot, site, manual or automatic application or process or any other way and reproduce the navigation structure or presentation of the Website and its content; (vii) modifying, adapting, sublicensing, translating, selling, performing reverse engineering, compiling or decompiling or otherwise attempting to deconstruct or appropriate or divert all or part of the Website or any software used on it or as part of the services or encouraging others to do so.

3. Information on Trademarks

The trademarks, associated designs, and any other names and logos appearing on the Website constitute registered or unregistered trademarks and trade names owned by the SIAQ or their respective owner or licensee (hereinafter collectively referred to as the "Marks").

Any use of the Marks not authorized by the SIAQ or not in accordance with the Terms is prohibited. At no time can the Terms be interpreted as granting any authorization by the licensee or owner to use in whole or in part the Marks, particularly those displayed on the Website, or the intellectual property rights held by the SIAQ, including copyrights on the content of the Website.

Except if the information is in the public domain or if you have obtained an appropriate prior written authorization from the SIAQ, you may not copy, modify, publish, transfer, transmit, distribute, perform, display or otherwise sell any information owned by the SIAQ, including all intellectual property such as Marks and copyrights, unless otherwise expressly authorized by the Terms.

4. Shop and Memberships

4.1 Terms for online store purchases (books and accessories, excluding training courses)

Final sales.
No exchanges or refunds.
No price adjustments for orders placed without member profile login.
A 5% administration fee will be retained on any order of reserved items made by a person or business not holding the necessary rights or titles for purchase. 

Books are sold on a final sale basis and are neither exchangeable nor refundable. Any return must be pre-authorized by the SIAQ.

In the event that the SIAQ exceptionally accepts a return, administration fees of up to 25% of the value of the returned books may be deducted from the refund or credit note.

Books returned without prior authorization may be refused. Shipping and return costs remain the responsibility of the customer and are non-refundable. 

4.2 Terms for training workshops and conferences

No cancellation after the registration deadline.
No refund after the registration deadline.
It is possible to transfer a registration to another person up to 24 hours before the event (unless otherwise stated).
Any request for cancellation or refund received before the registration deadline is subject to a 5% administration fee, which will be deducted from the refund. 
In the event of a refund, books included in a training course and already delivered cannot be refunded and will be deducted from the refund taking into account the retail price according to your membership status.
If you are a member, it is mandatory to log in to your profile to obtain the member rate. No price adjustment will be made if an order is placed as a guest.

4.3 Terms for memberships

Individual memberships are non-refundable and non-transferable.
Municipal membership is non-refundable but can be transferred to another person.
Commercial membership is non-refundable.

4.4 Shipping

Shipping in Canada
> Standard delivery times generally range from 2 to 7 business days.
> Orders shipped by Xpresspost or Priority must be placed before 11 a.m. for same-day shipping. 
> SIAQ cannot be held responsible for Canada Post delivery delays.
> Non-delivery and traceability of packages: By choosing a delivery method without tracking, the customer assumes the risks related to the loss, delay, or non-delivery of their package. SIAQ cannot be held responsible for these situations and no refund or replacement will be granted.

Shipping to the United States or internationally
> For shipments to the United States and other countries, SIAQ cannot guarantee the delivery date. Delivery times performed by subcontracted shipping companies and customs delays are usually approximate.
> Recipients are responsible for paying customs duties, taxes, and other additional fees for all orders outside of Canada.
> Shipments with tracking: In the case of non-delivery of a trackable package, a claim must be made with the carrier.
> Shipments without tracking: By choosing a delivery method without tracking, the customer assumes the risks related to the loss, delay, or non-delivery of their package. 
> Tracking is not offered for shipments of Canada Post's Small Packet USA Surface and Small Packet International Surface services.

5. Usernames and Passwords

The Website includes certain sections that are only accessible by SIAQ members who have been assigned a username and password by SIAQ. These usernames and passwords remain the property of SIAQ and, consequently, they may be cancelled or suspended at any time by SIAQ at its sole discretion, without notice and without incurring any liability whatsoever.

If a username and password have been issued to you, you are responsible for maintaining their confidentiality and for protecting against any illegal, malicious or unauthorized use of this username or password on the Website. You are also responsible for any use that may be made of your username and password. In the event that you become aware that your username or password may have been compromised, you must immediately notify SIAQ by contacting us through the Website, either by email via info@siaq.org or by phone at 1-450-689-9393.

SIAQ is under no obligation to verify the identity or authority of a person using a member's username or password, nor does it have any obligation to verify the true identity of any person who registers on the Website or who requests the issuance of a username and password or their eligibility according to the Terms.

6. Exclusion or Limitation of Liability

6.1. SIAQ is not responsible for online behavior on the Website or outside of it, of any user of the Website or member. You assume all risks directly or indirectly related to browsing the Website.

6.2. By becoming a member of SIAQ, you agree that SIAQ will publish your name and contact information in a directory accessible only to members. SIAQ disclaims any responsibility concerning the use of this directory by the members.

6.3. SIAQ is not responsible for any inaccurate, incomplete information or any error that may be found on the Website, including but not limited to the generality of the foregoing regarding the products and services sold on its store, whether these errors, inaccuracies, or incomplete information come from suppliers and/or manufacturers of the products, the Website, the members, or any failure or malfunction of equipment, in particular.

6.4. SIAQ is not responsible for any error, omission, interruption, delay, defect, operation or transmission delays, online communication errors or failures, theft or destruction, or any unauthorized access.

6.5. SIAQ is not responsible for any problem or malfunction of any telephone network or communication line, online communication computer system, server or provider, computer equipment, software, email malfunction, technical problems or internet traffic congestion, including any injury or damage to members or users or visitors of the Website, or to any computer of any person, related to or resulting from website visits or downloading any material from the Website or related to SIAQ's services.

6.6. SIAQ disclaims all responsibility and it is understood that under no circumstances, can SIAQ be held liable for any loss or damage, including any damage to persons, property, and even death, resulting or potentially resulting from website visits or the use of services offered there, the use of any content found on the Website or transmitted to members, any relationship, communication or contact between members, whether online, on the Website, or outside.

7. Privacy of Information

In this regard, we refer you to our Privacy Policy which includes our policy on the protection of personal information published on the Website.

8. Modification and Right of Termination of the SIAQ

The SIAQ reserves the right, at its sole discretion, to modify, discontinue, restrict, suspend, or terminate the Website at any time, in whole or in part, without notice and without incurring any liability to you or any other person.

The SIAQ reserves the right, at its sole discretion, to delete, add, modify, or change the Terms, in whole or in part, at any time. The changes made will take effect as soon as they are available on the Website.

It is your responsibility to regularly review the Terms of the Website to determine if any changes have been made that may affect you. By checking the date of the last update at the beginning of the terms, you can verify if modifications have occurred since your last visit or use of our Website. If any change is unacceptable to you, you must immediately cease accessing and using the Website.

If you access and use the Website after changes to the Terms have been posted, you are deemed to have accepted them.

9. Applicable Laws and Dispute Resolution

These terms, your access and use of the Website and services, as well as any related questions, are governed by the laws applicable in Canada and in the province of Quebec. All disputes between you and the SIAQ or any other person related to the Website, including any Subscriber, arising from these terms or any agreement that may have been entered into or arising from any communication with users or members, must be resolved by arbitration by a single arbitrator in accordance with the procedure established in this regard by the Quebec Code of Civil Procedure, according to the provisions in effect at the time the dispute arises.

SMS Messaging Terms and Conditions

Generalities

When you sign up for the service, we send you a message to confirm your registration.

By agreeing to receive messages, you agree to receive recurring automated marketing and informational messages from the Société internationale d’arboriculture Québec inc. (SIAQ). Automated messages may be sent using an automatic telephone dialing system to the mobile phone number you provided when you registered or to any other number you have designated.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with the SIAQ. The SIAQ reserves the right to change the frequency of messages sent at any time to increase or decrease the total number of messages sent. The SIAQ also reserves the right to change the short code, phone number, or alphanumeric sender from which messages are sent.

Standard messaging and data rates may apply. If you have questions about your text or data plan, it is best to contact your mobile service provider. Your mobile phone provider is not responsible for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Operators

Operators are not responsible for delayed or undelivered messages.

Cancellation

Messages will provide instructions to unsubscribe, either by sending an SMS to STOP or by clicking on a link included in the message. After unsubscribing, we will send you a message to confirm that you have been unsubscribed and that no more messages will be sent. If you wish to receive messages from the SIAQ again, you simply need to register as you did the first time and the SIAQ will resume sending you messages.
